  • Confidentiality Agreement

    Between the First Party

    Being: The Bridge Community Project, 20 Shairps Business Park, Houstoun Road, Livingston, EH54 5FD

    And the Second Party Being:

  • The Bridge Community Project by the nature of its role in the community handles a lot of information, a proportion of which is confidential and must not be disclosed to any third party.

    This can include written and/or electronically stored material, telephone and person to person conversations.

  • It is therefore agreed as follows:

    1. In consideration of the second party working at the Bridge Community Project and having access to confidential and/or potentially confidential information in any format, the second party hereby undertakes that they shall:
      • not communicate, disclose or make available all or any part of the Information to any third party;
      • not directly or indirectly use, or permit others to use, the information other than for the purpose of their role at the Bridge Community Project
    2. The second party shall ensure that all measures necessary are taken to secure the confidentiality of the first party's information including but not limited to:
      • keeping separate all confidential information and all information generated based on the confidential information from all other documents and records;
      • keeping all documents and any other material bearing or incorporating any potentially confidential information at the Bridge Community Project
      • not using, reproducing, transforming or storing any of the confidential (or potentially confidential) information in an externally accessible computer or electronic information retrieval system, not transmitting it in any form or by any means whatsoever outside of the Bridge Community Project and not copying all or any part of the information without the prior consent of an authorised person at Bridge Community Project and then only to the extent that the same is required for their current role;
      • allowing access to the confidential information only to others at the Bridge Community Project who have reasonable need to see or use it for the purpose of their role.
    3. The rights, duties and obligations of the parties and the validity, interpretation, performance and legal effect of this agreement shall be governed and determined by the laws of Scotland and the parties hereby submit to the non-exclusive jurisdiction of the Scottish Courts.
    1. In consideration of the second party working at the Bridge Community Project and having access to confidential and/or potentially confidential information in any format, the second party hereby undertakes that they shall:
      • not communicate, disclose or make available all or any part of the Information to any third party;
      • not directly or indirectly use, or permit others to use, the information other than for the purpose of their role at theBridge Community Project
      • get permission from the Bridge Community Project and the client before recording any sessions for training, assessment or supervision purposes. Reference needs to be given to COSCA guidelines for data recording.
    2. The second party shall ensure that all measures necessary are taken to secure the confidentiality of the first party's information including but not limited to:
      • keeping separate all confidential information and all information generated based on the confidential information from all other documents and records;
